Please read these Terms of Service ("Terms") carefully before using the services provided by Monarch Systems ("we," "us," or "our"). By accessing our website or using our services, you agree to be bound by these Terms.

1. Acceptance of Terms

By signing up for a trial, subscribing to a paid plan, or otherwise using any Monarch Systems service, you confirm that you have read, understood, and agree to these Terms. If you do not agree, you may not use our services.

We reserve the right to update these Terms at any time. Continued use of our services after any update constitutes acceptance of the revised Terms. The date at the top of this page reflects the most recent revision.

2. Description of Services

Monarch Systems is a California-based AI automation technology company. We provide automated missed-call text-back and lead engagement services designed for home service businesses, including HVAC contractors and related trades.

Our services include, but are not limited to:

• Automated SMS responses to missed calls.
• AI-driven lead follow-up and conversation handling.
• Integration with your existing phone system and CRM tools.
• Reporting and analytics on lead activity and response rates.

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time with reasonable notice.

3. Payment & Billing

Monarch Systems operates on a simple, flexible pricing model:

• Monthly subscription — $300 per month, billed on a recurring basis.
• No contracts — your subscription is month-to-month with no long-term commitment required.
• Billing cycle — your card is charged on the same date each month following the end of your free trial.
• Payment methods — we accept major credit and debit cards. Payment is processed securely by a third-party payment provider.

All fees are stated in U.S. dollars and are non-refundable except as described in the Cancellation Policy below. We reserve the right to adjust pricing with at least 30 days' written notice to active subscribers.

4. Free Trial

New customers are eligible for a 14-day free trial upon sign-up. No credit card is required to start your trial.

• The trial period begins on the date you activate your account.
• Full service features are available during the trial period.
• If you choose to continue after the trial, you will be asked to provide payment information to activate a paid subscription.
• If you do not wish to continue, simply let the trial expire — no action required and no charges will be made.

Monarch Systems reserves the right to modify or discontinue the free trial offer at any time without prior notice.

5. Cancellation Policy

You may cancel your subscription at any time with no cancellation fee.

• How to cancel — contact us at luke@monarchsystems.ai and we will process your cancellation promptly.
• Effective date — cancellations take effect at the end of the current billing period. You will retain access to the service through that date.
• Refunds — we do not issue partial refunds for unused time within a billing period. If you believe an error has occurred, contact us and we will review your case.

6. Limitation of Liability

To the fullest extent permitted by applicable law, Monarch Systems and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, lost revenue, or loss of data — arising out of or related to your use of our services, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising out of or relating to these Terms or our services shall not exceed the total amount you paid us in the three (3) months preceding the claim.

Our services are provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

7. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict-of-law principles. Any disputes arising under these Terms shall be resolved in the courts located in California.
